DISTRIBUTION, REGISTRATION AND LICENSING OF EVALUATION COPIES WinNAV is a copyrighted and proprietary work; however, unregis- tered evaluation copies may be distributed through accepted shareware channels. Appendix B-2 PERMISSIBLE DISTRIBUTION OF EVALUATION COPIES To ensure future development and support of WinNAV, you are encouraged to distribute unregistered evaluation copies to oth- ers, subject to the terms and conditions of the limited evalu- ation license and restrictions. GENERAL DISTRIBUTION Operators of electronic bulletin boards (Sysops) are encouraged to post WinNAV for downloading by their users. WinNAV may be uploaded to and downloaded from commercial systems such as CompuServe, the Source, and BIX, so long as the only charge paid by the subscriber is for on-line time and there is no charge for the product itself. Those copying, sharing, and/or electronically transmitting this product are required not to delete or modify the copyright notice and restrictive notices from the program or documentation; anyone doing so may be subject to civil damages and criminal prosecution. If you are passing WinNAV on to others, uploading it to a bulle- tin board system, or including it in a users group library, do not separate the files contained in the packed ARC, ZIP or LZH archive file -- pass the entire packed file on to the intended party. This ensures that those who receive the product will have all the correct configuration utilities and documentation neces- sary to get WinNAV up and running quickly, and avoid possible corruption of the files. A listing of what files you should have and the purpose of each is listed in this manual or the accompa- nying README.TXT file. WinNAV documentation may not be modified, nor may be distributed separate from the application program. In addition, the distri- bution documentation may not be printed, copied or otherwise reproduced, by any means, without the written permission of the author and copyright holders or pursuant to a registered user license. Appendix B-3 COMMERCIAL DISTRIBUTION Notwithstanding the foregoing, commercial vendors and distrib- utors of "public domain" or user-supported software libraries must obtain written permission to distribute copies of WinNAV, except as hereinafter expressly permitted. No one may use WinNAV as a promotion for any commercial venture or as an enticement for the user to pay for any program, product, or service unless they have received the express written permis- sion of the program's author. In order to distribute WinNAV, a dealer or disk vendor must com- ply with the following conditions: (1) You must obtain written permission from Richard S. Patterson to distribute WinNAV, unless you comply with the provisions of paragraph (7) below. If you receive no reply, write again; my silence does not constitute permission, and you may not distribute "pending" receipt of permission. (2) A maximum disk fee as set by Richard S. Patterson in the vendor contract must not be exceeded. WinNAV may not be included on any disk sold for more than this maximum, including CD-ROM or optical disks, without express written permission from Richard S. Patterson. (3) Although not required, it is strongly recommended that each dealer or disk vendor, purchase a master disk copy direct from Richard S. Patterson, rather than distribute copies obtained by electronic means. This insures that your purchasers will obtain the full, uncorrupted distribution package, and the most current release and utilities. These disks may be ordered by use of the registration form distributed with this package; please indicate thereon that you are requesting a master disk for redistribution pur- poses. All vendors who have ordered disk copies of the next release, should receive them within ten (10) days of the public release date. Vendors who wish to receive disk copies of a current or future official release of the WinNAV distribution package, direct from the author, must provide (1) a self-addressed stamped disk mailer together with a Appendix B-4 preformatted high-density diskette (3.5" 1.4 meg rec- ommended), or (2) $5.00 to cover postag, handling and media charges. We are sorry that we cannot provide "free" disk sets at this time, due to the high volume of requests we have been receiving. (4) Vendors may not modify or delete any files in the archive file, and should distribute full copies of any master disk. Vendors may add a "GO" program, and/or a reasonable number of small text files designed to assist or provide a service to the user, but these added files must be easily identifiable and end-users must be allowed to delete the added files. (5) Vendors must make a reasonable effort to distribute only the most recent versions of WinNAV. Generally, we will attempt to notify all vendors who have requested and received written permission to distrib- ute WinNAV of each major update as they are released. (6) All disk vendors must comply with any and all vendor guidelines or vendor requirements set forth by the Association of Shareware Professionals (ASP); for more information about ASP, contact its chairman or ASP, located at 325 118th Ave. S. E., Suite 200, Belleview, WA 98005. Violation of any ASP guideline or requirement automatically revokes permission to distribute WinNAV. (7) Written permission to distribute evaluation copies of WinNAV is not required, for those vendors who comply with paragraphs (2)-(6) above, and agree to distrib- ute WinNAV on a separate disk, rather than as a collection of utilitiy programs. This disk must be identified in their respective catalog and advertise- ments as the FlashPoint WinNAV disk and by a seperate disk or order number. In addition, as disk space permits, the vendor must include reasonably current copies of the following third-party shareware utili- ties which are supported by WinNAV, i.e., PKZIP, LHARC/LHA, ARC and/or PKARC, McAfee's SCAN and Starling's CVT-22; copies of these utilities will be supplied the vendor pursuant to paragraph (3) above. Appendix B-5 LIMITED EVALUATION LICENSE AND RESTRICTIONS The unregistered evaluation copy of WinNAV is, for purposes of distribution, a shareware product. It may be freely copied and distributed for evaluation pursuant only, pursuant to the follow- ing rules: (1) The program and this documentation may not be modi- fied in any way. (2) A copy of this documentation is provided with the program. (3) No charge, other than a media and handling charge not to exceed $10.00, excluding actual postage, is made. (4) Users of the program must purchase a Registered User's License should they decide to use this product beyond the evaluation period. One license per usable copy of WinNAV is required, and the pro- gram may not be used beyond a thirty (30) evaluation period without registration. A single archive or backup copy is not considered a "usable copy" for evaluation or registration pur- poses. Please note that if you purchased a disk containing this software from a public domain/shareware software distributor or vendor you have paid the media and handling charges as permitted above. This is not a registered copy, and you have not purchased a Reg- istered User's License. Purchasing a license is required for continued use. No other person, other than the author Richard S. Patterson, may accept payment or royalties for this product.
